Can you Afford It!

A claim denial doesn’t mean you can’t get your disability benefits. The same way you may not have filled in your paperwork correctly is the same way the VA almost always makes errors in its determinations. The denial can stem from not having all of the facts layed out the proper way and/or stem from not having proper evidence submitted with the application.

Here are a few reasons for denials:

• Not enough medical evidence to support your disability;
• Not enough evidence to show that your disability is due to an injury occurred in service.
• They may agree that you have a disability that is service-connected and still assign a rating that is too low for your actual symptoms; Ratings determine your benefit amount.
• They may resort to stating that you had a pre-existing medical condition prior to your military service.
• No evidence of actual combat.

While statutes regarding PTSD have relaxed to make claims easier to approve due to the condition, you still need to show proper medical proof. Likewise, regardless of medical diagnoses, you must provide solid documentation to refute chance of appeal or even multiple appeals. Gather all of your military and medical records on your own to provide with your initial application or appeal. Make sure that your physician has written evidence, which he or she can provide you with, to show a connection between your disability and military service.

Failure to do so can lead to a wait time of up to or over 8 years which means many of our veterans and their family members have to find other means to support their family while disabled and can even lead to homelessness.
